Under the Ontario Family Law Act to “cohabit” means to live together in a conjugal relationship, whether within or outside marriage. Section 53(1) of the Family Law Act explains a cohabitation agreement is one between two individuals who currently or intend to cohabit and are not married. The agreement is one concerning their rights and obligations while cohabiting, after a separation or following the death of one of the cohabiters. These rights and obligations include things such as; the ownership in or division of property, support obligations, directing the education of the children (not including the right to custody following a separation) as well as other matters associated with the settlement of the couples affairs.
In the event a couple with a prior cohabitation agreement gets married, that agreement will become a marriage agreement as per the Family Law Act s. 53(2)
There is a lot that goes into a divorce or separation proceeding and it can be complicated. As a result, it is important to be prepared and informed before initiating such a process. Upon telling your spouse or partner of your intentions they will likely seek the advice of legal counsel and as a result it would be wise to seek your own legal counsel prior to informing your partner. The amount of material required for a separation or divorce means it may be difficult to compile all of the necessary records in a small amount of time. Therefore, before you inform your spouse or partner you will want to compile as many of these documents as possible to ensure a clean and speedy process with less problems along the way. Things to compile include income tax receipts, pay stubs from your employer and a valuation of your various assets. These are not all the documents necessary that is why it is best to speak with a lawyer to ensure you have everything you need before informing your spouse or partner of your intentions.
What steps are involved in a divorce/separation?
Yes they can. Canada has extended its Pilot Program which offers a Work Permit to certain sponsored spouses/partners!

"Professional and courteous staff, nice office location with ample parking, reasonable fees and above all I had very satisfactory experience of their legal consultation"
AP Lawyers were a pleasure to deal with from the get go. Sharaya was my first point of contact and she was very welcoming and helpful with all my queries. I had a phone consolation with Angela, she was very professional, honest and knowledgeable. I went to the office and met with Shireen Abdi and I would defiantly recommend her again and again, she is kind, knowledgeable, genuine and sharp at what she does. Thank you!
I had a consultation via Skype with Angela. She sounded great, much better than the last lawyer I consulted with. She is really "there" when you talk to her. When she said they give "tough love" combined with their great Google reviews I said I'm in. I knew they cost more than other lawyers, but I consulted with less expensive ones and didn't want to take any chances. Brendan M. McDermott was my lawyer. He seemed fine and wrote a good letter to the opposing council, Ms. Lyna Perelman. However I spoke to him once on the phone and was underwhelmed. Too much "blah, blah, blah" for mel He left the practice and I had a choice of staying with him or having somebody there take over and I chose the latter. At first they said I would have to pay for somebody to catch up on the case and I said "no", since that is not the way the rest of the world works but we got passed that little bump. Anyway Sherine Abdi takes my case and she has been amazing! She took the step of phoning when she saw it as more efficient. She was very conscious of how over $200 a day forgone investment was lost since funds from the sale of our house were held up. She didn't suggest fighting the stupid ideas from Ms. Lianne Eklove (Ms. Perelman dropped our case) and kept a balance in between standing up to nonsense and letting other issues go. When I spoke to Sherine on the phone she stuck to the issues, none of that "blah blah" talk. We had the case wrapped up quickly. She behaved as I expected anyone hired by Angela to behave. So nice to have a little silver lining in a very dark cloud of my life. Thanks Sherine. One last thing to all of you, don't use your lawyer as a therapist. It's not their job and they will charge you for it, just do what I did, "get'er done"!
Angela was kind and understanding and gave me the right advice I needed for my current situation. Truly provided a wonderful experience and excellent advice. Thank you thank you.
I highly recommend AP lawyers. Excellent service. My consultation was with Anisa and it helped me a lot for my current situation.
Ms. Pricewill is kind, extremely knowable, patient and she genuinely wants to help. She takes the time necessary to adequately guide you through your legal maze. Also she gives you realistic cost and outcome expectations and does not try to sell you on her services instead she focuses on what's best for you and your unique situation. Thanks for your help!
I want to thank Angela Princewill for the way she is handling my case. She is very passionate about my rights. My case is very complicated involving divorce, custody, access, child support and property division. I am confident she will get me the best results in every area.
