To apply for a divorce the law requires you and your spouse to live separate and apart for one year before the court will grant your divorce.
In some cases, couples choose to reside together in the same home during this period for financial reasons or to better support the children. This is acceptable by courts so long as the couple is living separate and apart within the home.
A divorce proceeding can be contested (contentious) or uncontested (amicable). With a contested divorce it can be difficult to reach agreements, agree on property division, child custody and access, and other such matters. This type of divorce can be very complex and drawn out.
With an uncontested divorce, couples are willing to work out their own agreements with assistance from their divorce lawyers. Since the couple is agreeable, the process is less stressful and easier for both parties to move forward with their new lives.
Steps in the Divorce Process
After an application for divorce is submitted to the court, it also has to be served on your spouse. Your spouse will have up to 30 days to file an Answer with the court.
If the parties are amicable, it is better to file a joint divorce application. This is a faster and more streamlined process but the process can take between 3 and 4 months to complete.
Before a court will issue a divorce order where children are involved, the courts will want to know that proper arrangements regarding child custody and access as well as child support have been made.
The divorce application process could also include claims for child custody and access, child support, spousal support, division of marital property, and disposition of the marital home.
